Texas House Attemps to Tackle Illegal Immigration

Some state lawmakers want to revive the immigration debate in the Texas Legislature. Texas lawmakers revived discussions by proposing more than a dozen bills that, among other things, would punish employers for hiring illegal workers and challenge the U.S. citizenship of illegal immigrants’ U.S.-born children.

Other bills filed for the 2009 Legislature would require public schools to maintain records on students’ immigration status, impose a fee on money wired to Latin America, require identification from voters at the polls, prohibit parole for illegal immigrants and create a state criminal trespassing charge for illegal immigrants enforced by local police.

Several of the proposals are similar to ones that were introduced in the last session, which failed to make it out of committee because they were considered unconstitutional.

In February 2009, Texas Attorney General Greg Abbott issued a legal opinion that concluded that a proposed state law that would suspend the business license of any employer that hires illegal aliens would be constitutional under federal law.  The AG found that the legislation proposed in Texas – which closely mirrors an Arizona law – does not conflict with the federal government’s constitutional role in immigration matters.  

Two years ago, more than a dozen bills targeting illegal immigration were stalled by an attorney general’s ruling that they were too broad or impinged on the jurisdiction of the federal government. A number of Republican lawmakers have worked to refine bills for this legislative session that give the state tools to discourage and punish illegal immigration.

 The legislation is currently pending in the Texas state legislature and, if passed, would provide Texas with additional enforcement measures to ensure employers are not hiring illegal aliens, but instead hire only workers who are authorized to work in the United States.

Once again, most important immigration bills were sent by Speaker Joe Straus to the House State Affairs Committee. He appointed State Representative Burt Solomons chair of that powerful committee.

In the estimation of many prognosticators in Austin, conservative committee chairs have made it their mission to see that important immigration bills die again in committees by not giving them hearings. Solomons has introduced an immigration bill of his own, HB 3949 which requires applicants for many occupational licenses be eligible for employment in the U.S. 

To date Solomons and his committee have taken no action on any bill relating to illegal immigration.

As long as we have illegals we are endangered. It is like traffic laws. They are designed for safety and when broken by law enforcement. We obviouly have incompetant law enforcement in imigration. That is not acceptable in Texas.

be here. It is the responsibility of the government to take
action and enforce the laws that we have.

They are illegal…they are breaking the law.

Our legislators need to stand strong in support of the LAW.

Amen! Why won’t our GOVERNMENTS, that’s plural. In force the LAWS that are already on the books. Big labor has paid off many politicians to turn a blind eye to this enormous FINANCIAL problem. $4.7 billion here and $4.7 billion there, pretty soon it adds up to real MONEY!

I think it is a good idea to question the children born of illegally born in the United States. They should be here legally or the children should be considered illegal children of illegally. The illegally get free medical care from our hospitals such as Parkland in Dallas. The cost of medical care should be born by the illegal immigrant who comes here to have their children. One requirement to be with a legal status should be the ability to speak English and show proof that they are here legally. The parents should show that they are citizens of the state or are here on a legal visa. Regardless the cost of medical care should be charged to them to be paid by insurance or cash. Our schools have special classes and additional teachers to teach them English because they are considered disadvantaged or impaired. They are given special attention the entire 12 years of schooling which legally born students do not get. If we made it a requirement to be born here legally before they could enroll them in schools it would discourage pregnant women from crossing over into the United States just to have there children born where with all the advantages of law abiding citizens. The schools in Texas are not allowed to ask if they are legal or if they even have birth certificate showing them to be a nationally born in the United States. If they want to attend school and are not born here by legal immigrants the should be made to pay a tuition for the education to off set the cost of teaching them English and having additional teachers to educate them in the English language. Unfortunately the schools get aid from the state and federal government for each child in attendance and that is primarily why they instruct the teachers and staff not to ask question. The schools that allow children of an illegal immigrate to attend school with out the burden of proof should be fined as well as the business that hire there parents.

I like the idea of making schools keep track of the legality of their students.

GET SERIOUS ABOUT THIS. Illegals are here because employers are willing to hire them at low wages. Fine the employers enough that it will get their attention–maybe $100,000 per illegal.

I, also, like fining the illegals for trespass. Stick it to them–maybe $2,000 for first occurrence, and double the fine for repeaters. Give them to the Border Patrol to send home, after holding them in jail for 60 days. Word will get out and they will avoid Texas.

Everyone coomenting on this needs to do two things. First remember that Kay Bailey Hutchison gutted the legislation to build the border fence with her amendment–she is our opponent in this matter–I sure don’t want her for governor of Texas. Second, write Senator John Cornyn right now and tell him that we don’t need to consider more immigration reform until we build a border fence and start enforcing our current laws.

I may sound mean, but actually, I like our Hispanic citizens and I recognize the fact that many of them are exactly the kind of citizens we need and want in our country, but they must come here LEGALLY.

The committee chairman that is deliberately stalling the immigration bills represents Denton. I suggessted that he pay attention to the 90 PERCENT APPROVAL OF THE VOTERS IN THE 2008 PRIMARY ELECTION but he apparently knows better than the voters. He needs to be removed come next election.

Yes Edna. As of 4-7-09, Solomons was still not allowing a vote on at least six of the House Bills (HBs 266, 276, 404, 622, 658 and 1061), which deal with most of the immigration issues mentioned in these comments. I sent him, his co-chairman and my Representative e-mails requesting the six be voted on immediately; but, as yet, I guess this has not happened.

MR SOLOMONS, YOUR HB (3949) DOES NOT BEGIN TO COMPARE WITH THE SIX HBs (266, 276, 404, 622, 658 and 1061) THAT YOUR HOUSE STATE AFFAIRS COMMITTEE IS SITTING ON.

BASED ON MR. MCGEE’S COMMENT, I WOULD STRONGLY SUGGEST THAT YOU (MR. SOLOMONS) START DOING YOUR JOB FOR TEXAS; NOT FOR SOME SPECIAL BUSINESS INTEREST TO WHICH THE DESCRIPTION OF YOUR BILL INDICATES IT IS GEARED.

Folks, Solomons is only part of the problem, speaker Straus received his chairmanship by promising the Dems and a few RINO Republicans that certain “controversial” legislation would never see the light of day. Namely immigration enforcement.

Solomans got his Committee Chair job by making the same (wink, nod) promise to the Speaker.

So the strategy this session is to let a few enforcement bills out of the Senate only to kill them in the house.

One of their methods is to schedule them late in the session, so they can use the excuse that they just run out of time.

Unfortunately, there are a number of good immigration enforcement Bills that will probably not become law for one reason or another, the main one being that they are rapidly running out of time to pass both the House and the Senate before the end of this Legislative session. (The only hope for some very good Bills that may have only passed on one side would be to be “tacked on” as an amendment to a Bill that had already passed on the OTHER side. Another problem, such as that which exists with SB 357, is that it carries a significant fiscal note that would probably kill any Bill this session. (The estimated 2-year expenses for this program would be about $961,000…with about $485,000 over the following 3 years.) I’m guessing that this alone will probably prevent its passage because our state budget is so tight.

However, we should really concentrate our phone-in efforts to the Senate Transportation and Homeland Security Committee and its members on SB 358. There’s NO associated fiscal note on this one! (Call, express your support and ask that it be voted out of their committee with a recommendation that it pass the full Senate.)

Note: SB 358 has companion Bill, HB 404 (by Rep. Harless); and it, along with the following additional enforcement Bills are scheduled for public testimony in the House State Affairs Committee on Tuesday, April 21st. It’s highly ironic that this day is a “special” holiday for most state employees. It’s San Jacinto Day…but I’m not going “there.” Other immigration-related Bills to be heard are HBs 48, 139, 276, 1061, 3949, and 4675. You can look these Bills up at http://www.capitol.state.tx.us and make copies to review. Bill analysis is fascinating, and if anyone is interested in testifying (It’s a great way to get involved.), the committee will be meeting in Room 140 of the John H. Reagan Bldg. (just north of the Capitol on the SW corner of Congress Ave. and 15th St. The start time is given as 2:00 PM or upon adjournment of the House…and the latter event can vary. (If they adjourn early, they might start at noon; and this can be frustrating sometimes for those members of the public wishing to speak.) Even if you don’t want to testify orally, you may submit written testimony…or you can just register your support or objection to a Bill by filling out a “Witness Affirmation Sheet” and turning it in to the committee clerk. The only bad part is that you have to fill out a separate sheet for each Bill.

Finally, HCR 50 – by Rep. Creighton (a House Concurrent Resolution affirming Texas’ sovereignty under the 10th Amendment to the U.S. Constitution) will also be up for public testimony. This is definitely one to support to the fullest…serving notice to the feds, and telling them where to “stick” their unfunded mandates, etc. It should be very interesting to see which elected officials show up to speak on this one and to watch the posturing for the cameras.

Hope to see some of our folks from the border area there with stories about how illegal immigration is negatively affecting their communities..

I am for any bill that makes an attempt to stop “illigal” immigration! They have been getting our benefits that we work hard for! It is wrong that their babies that our born here that our taxes pay for give them a pass to stay here! They have gotten our welfare benefits and every other benefit you can think of that they do not and should not have rights to! The children born here and have illegal immigrant parents should be considered illegal also! I am tired of being taken advantage of in the health care, education, welfare, and every thing these people have found their way in to get! They are sucking us dry–many of them come over here to bring drugs, rob and mug us, and even kill us. They drive their rattletraps over here without insurance, and on some occasions have been known to cause accidents so they cna ge the insurance money! It is outrageous and criminal and I want is stopped!

SEND THEM PACKING! SECURE OUR BORDERS AND GET THEM FENCED! NO AMNESTY FORGOD’S SAKE!!!

Seems to me that Tea Party focus must now turn to two or three really critical conservative issues that apply nationwide, AND to one that wakes up Texas congress as well. So let’s start in Texas with illegal immigration. Press the issue that something must be done, even if it means a special session – since they’ve drug their feet so far this time.

If grass rooties get focused and avoid the infighting, and stay together we can change the political landscape for the good of all and serve as a model for other states.

Children born to people who are not in US legally and specialy not in Texas legally should not be citizens of the US.
Driver licenses should not be available to illegal aliens. Driver licenses should expire when visas expire.
No one should be allowed to vote without photo identification and proof of citizenship. We also need a means of keeping people from voting more than once– maybe a dye on a finger that will NOT wash or wear off for a couple of weeks when a person votes.

We should have tea parties every month. Each on a different issue. That way folks that will be interested in one issue will attend one that might get them involved, whereas they would not get involved on another issue that doesn’t affect them.

First taxes, then illegal immigration, then gay people, then putting religion back into our classrooms, then corporate greed, etc. It is time we took back these things and fixed them. If we had a tea party a month, in 6-8 months we’d have a movement and lots more people.

Our tea party was spendid.

Nevermind HB 3949, it has an exemption for Race Tracks (has a buddy that owns one I figure…)
Also, a Canadian Driver License as one requirement for EMPLOYMENT….. NOTHING TO DO WITH CITIZENSHIP….

For HB 404 (Harless) – relating to the enforcement of state and federal laws governing immigration by certain governmental entities. (Patrick – SB 358 companion)

For HB 1061 ( Jackson ) – relating to the requirement of citizenship or lawful presence in the U.S. for issuance or renewal of certain occupational licenses, driver’s licenses, and identification certificates.

For HB 276 (Zerwas) – relating to the requirement that state agencies report the cost of services and benefits provided to unlawful immigrants.

For HB 48 (Riddle) – relating to the suspension of certain licenses held by employers for the knowing employment of persons not lawfully present in the U.S.

I believe we need to close our borders and Texas needs to take all the resources they have to defend their borders and not wait on the federal government to concur. It saddens me that the kids of illegals are caught up in this process and in the end no one wins. Texas schools spend a lot of money educating illegal immigrants children. We should not be paying for this. It is time to stop this insane abuse. People of Texas are caring and loving but our government has become overbearing in disregarding our wishes on this policy. Pleae for everyone’s sake put an end to all of this.

Texas needs a governor that is a leader but most importantly, one that has GUTS and a MAN OF HIS WORDS.

I’m tired of being expected to know Spanish to have a job in my own state. And why do illegals get to have jobs when so many citizens are unemployed? Every government official who stalls or fails a bill to get rid of illegals should be removed from office. They obviously have alterior motives… probably pocketbook.

Anchor babies were smuggled in by illegals & no more a liegal citizen than their illegal parents. Send them packing w/ the illegals who brought them in.

When do American citizens’ rights & security in their own country come first? Why are our very own government officials protecting these lawbreakers? Kick them out of office now.

When do taxpayers get to have a say in how our money is spent? The profuse bleeding of the American taxpayer needs to come to an end.

I agree that anchor babies cannot possibly be legal citizens since technically they were smuggled in by illegals & are no more legal citizens than those who smuggled them in.

BTW, I don’t believe there’s a statue of limitations on being in the country illegally. Hunt their butts down & deport them… along w/ LULAC, MALDEF, LaRaza, lawyers & judges who defend them and people like UT Arlington’s Jose A Gutierrez who spews things like whites need to be killed. And WE are racist for wanting our immigration laws enforced?

Every city, state, etc that’s gone after employers for hiring illegals has seen a dramatc drop in crime. It’s time Texas followed suit. Fire every govt member who tries to stall it.

Seriously, how do we get the politicians who don’t side w/ Americans out of office? How do we force our govt to go after employers & landlords? If it weren’t for illegals being able to be dropped off 3/4 miles from my house at a non-bus stop, buy homes & rent to more illegals, I wouldn’t have lost everything when they walked to my house twice & took everything I own.

Also, with 15 million Americans out of work & 12 million or so illegals here, how can they justify letting them work? How can we be expected to suddenly learn their language so employers can pay cheaper wages? How can they allow companies to require everyone above the lowest wage employee t speak Spanish so they can employ these illegals who refuse to learn our language?

so here the government is spending millions and millions on a never ending war that doent know how to live in peace. My thought is bring the soilders home(USA) have them set up post along the border to keep illegals from coming over. Enough is enough government people!! Your taking away from our elders that have busted their butts putting in years and years only to retire to NOTHING!! You give illegals healthcare and funding for what? We need to take care of our vetrans and elders before giving to lazy people that expect it all handed to them.
